By accessing or using Heddle AI's Wear application and website (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.
App Users: "App Users" refers to users who have downloaded the Heddle AI Wear application from the Apple App Store or Google Play Store. For Apple App Store users, this End-User License Agreement ("EULA") is concluded between you and Heddle AI only, and not with Apple, Inc. ("Apple"). Heddle AI, not Apple, is solely responsible for the Licensed Application and the content thereof. Apple and Apple's subsidiaries are third party beneficiaries of this EULA, and upon your acceptance of these terms, Apple will have the right to enforce this EULA against you as a third party beneficiary.
Subject to your compliance with these Terms, Heddle AI grants you a limited, non-transferable, non-exclusive license to use the Service for your personal, non-commercial use.
App Users: The license granted to you is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (for Apple App Store users), or as permitted by the Google Play Terms of Service (for Google Play Store users).
You represent and warrant that your use of the Service complies with all applicable laws and regulations. You are responsible for ensuring that your use of the Service does not violate any applicable legal requirements in your jurisdiction.
Additional Requirements: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with applicable third party terms of agreement when using the Licensed Application, including your wireless data service agreement.
Heddle AI provides a virtual try-on technology that allows users to digitally try on clothing items. The Service may include features such as receiving shared images, creating digital versions of clothing, and virtually trying on these items.
To use certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account.
The Service may allow you to upload, submit, store, send, or receive content. You retain ownership of any intellectual property rights that you hold in that content.
You agree not to use the Service:
The Service and its original content, features, and functionality are and will remain the exclusive property of Heddle AI and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Third Party IP Claims: In the event of any third party claim that the Licensed Application infringes that third party's intellectual property rights, Heddle AI, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Heddle AI provides technical support and maintenance for the Service. We strive to keep the Service operational and up-to-date, but cannot guarantee uninterrupted service at all times.
App Users: Heddle AI is solely responsible for providing any maintenance and support services with respect to the Licensed Application. Apple (for Apple App Store users) or Google (for Google Play Store users) have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Heddle AI is responsible for addressing any claims relating to the Service, including but not limited to product liability claims, regulatory compliance issues, and consumer protection matters.
App Users: Heddle AI, not Apple or Google, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of the Licensed Application, including product liability claims, claims that the Licensed Application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
In no event shall Heddle AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. This limitation of liability does not limit Heddle AI's liability to you beyond what is permitted by applicable law.
Heddle AI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied.
App Users: In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple (for Apple App Store users) or Google (for Google Play Store users), and they may refund the purchase price for the Licensed Application to you according to their respective refund policies. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the Licensed Application.
